When 'Swarm' Doesn't Mean What Regulators Think: How the FCC's Drone Ban Could Ground America's Aerial Light Shows

For the Federal Communications Commission, it turns out, it means something far more ominous — and the gap between those two definitions may determine whether large-scale aerial light shows survive in the United States.
On July 21, 2026, the FCC released Public Notice DA 26-758, a proposal to ban the continued importation and marketing of previously authorized foreign-made drones the agency classifies as "military-grade." The notice lists seven capability categories that would trigger the restriction. Six of them — platforms weighing 55 pounds or more, chemical-dispensing sprayers, thermal imagers, LiDAR sensors, autonomous docking stations, and airframes built to carry defense articles — are aimed squarely at heavy industrial and defence-adjacent hardware that entertainment operators do not fly.
Category 7 is where the problem starts for the light-show industry. The FCC's proposed definition of "Swarming UAS" covers two classes of aircraft: autonomous systems that coordinate without human intervention to maintain formations and respond to dynamic threat environments, and — in the same breath — aircraft "purpose-built to perform flights in coordinated and synchronized formations, including applications such as multi-UAS light shows." The entertainment use case is named explicitly in the regulatory text.
Skyworx Drone Shows, a Boise, Idaho-based operator that produces hundreds of shows per year for municipalities, event producers, and corporate clients nationwide, has formally asked the FCC to exclude purpose-built aerial entertainment platforms from that definition. The company's argument rests on a straightforward technical distinction: its aircraft are designed for exactly one function — executing preprogrammed, pre-choreographed flight paths, not dynamically adapting to threats or coordinating autonomously in real time.
Taylor Woodall, Founder and CEO of Skyworx, raised a practical safety concern alongside the definitional one. Swapping in domestically made or otherwise untested hardware is not simply a supply-chain substitution: original equipment manufacturers engineer their hardware, firmware, and show-control software as a single integrated system. Introducing untested replacement components — regardless of their country of origin — risks compromising show safety.
Skyworx is not alone in its objection. Public comments filed in PS Docket No. 26-189 before the September 2, 2026 deadline show the light-show sector pushing back hard. James Vautin, Founder and Chief Pilot of New York-based Illuminaero, made the technical case in his filing: light show aircraft execute trajectories that are computed entirely before takeoff, then played back under GNSS positioning inside a predefined geofence — a fundamentally different architecture from adaptive military swarming. Glenn Reese, Head of Celestial Drone Shows, used the same logic, describing his aircraft as "airborne pixels" incapable of selecting objectives, identifying targets, or collaboratively executing a mission.
The supply-chain reality behind those filings is stark. The US light-show industry is built predominantly on foreign-manufactured hardware: Korean-made fleets dominate among the largest American operators, and Chinese manufacturers supply much of the global show-drone equipment market. Skyworx's own CES 2026 deployment — a 1,200-drone show above the Las Vegas Strip, with four full-scale performances executed within three hours by a six-person crew — was carried out using hardware from Chinese manufacturer DAMODA.
If the proposal is adopted without modification, it would not merely prevent operators from buying new foreign-made show drones; by restricting the importation and marketing of previously authorized equipment, it could cut off the supply of replacement parts and spare units for fleets already in service. The FCC has tentatively concluded that the economic impact of its proposal would be minor, on the basis that military-grade models are a small minority of the overall market. The drone entertainment industry disputes that framing, arguing that within their specific sector, the affected hardware is effectively the entire market.
The notice carries a 180-day wind-down period after any final action. No specific drone models have yet been identified for restriction, and the FCC has explicitly invited comment on whether any of its seven categories fail to accurately capture genuinely military-grade equipment — a question that now sits at the centre of the industry's pushback.

Regulators: The FCC's proceeding has generated nearly 3,000 public comments — a volume that signals the breadth of unintended consequences embedded in a capability-based definition drafted without sector-specific carve-outs. The agency's own invitation to comment on whether any listed category is "not truly military-grade" gives the light-show industry its clearest regulatory lever: arguing that coordinated formation flight for entertainment purposes is categorically distinct from autonomous, adaptive tactical swarming.
Domestic drone industry: The FCC's broader Covered List actions since December 2025 have channelled over $4 billion toward US-based drone and component manufacturers. However, no domestic producer has yet demonstrated the ability to fill the entertainment show-drone niche at scale — meaning a supply gap could persist even if domestic investment accelerates.
Investors and integrators: Uncertainty over Category 7's final scope introduces material procurement risk for any operator, integrator, or event promoter planning large-scale drone entertainment deployments in 2027 and beyond.
